Successfully navigating the Intra-Company Transfer (ICT) process involves more than just submitting an application. Both employers and employees must prepare for legal, logistical, and procedural requirements to ensure a smooth relocation and compliance with Canadian immigration rules.

Support for Employers

Employers play a critical role in sponsoring and facilitating intra-company transfers. Key areas of support include:

1. Establishing a Qualifying Relationship

  • The foreign and Canadian entities must have a parent, subsidiary, branch, or affiliate relationship

  • Proper documentation must be provided (e.g., ownership charts, registration papers)

2. Preparing the Job Offer

  • Offer letters must include:

    • Title and duties

    • Work location

    • Salary and benefits

    • Start and end dates

  • The role must match one of the eligible categories: Executive, Senior Manager, or Specialized Knowledge

3. Setting Up a Canadian Office (for new operations)

  • Registering the business in Canada

  • Securing office space (lease or ownership)

4. Employer Portal Submission

  • If required, the employer must submit an Offer of Employment through IRCC’s Employer Portal and pay the $230 compliance fee

  • IRCC may conduct audits or site visits

Support for Employees

Employees being transferred under the ICT program must be prepared to demonstrate their qualifications, employment history, and intent. Key responsibilities and needs include:

  • Letter of reference from employer confirming role and duration

  • Booking travel once the permit is approved

4. Family Sponsorship

  • If accompanied by a spouse or children, the employee may need assistance with:

    • Spouse open work permit

    • Study permits for dependent children

    • Visitor records or TRVs
